Terms of Service

The rules for using this site, what we are and are not offering you, and what happens if something goes wrong.

Updated

01The agreement

This site, https://www.nothingsoff.com, is operated by LMJ Productions, 7 Parrish Pond Lane, Southampton, NY 11968, United States ("we", "us"). By using it you agree to these terms. If you do not agree to them, please do not use the site.

These terms cover the website. They do not cover coaching, a speaking engagement or a sponsorship, each of which is agreed separately in writing, and they do not cover YouTube, Spotify, Apple Podcasts, Zoom or any social platform, which have their own terms.

02This is not treatment, and not advice

Everything on this site is one person's experience, told in public. It is not medical, clinical, psychiatric, psychological, therapeutic, financial or legal advice, and it is not a substitute for care from somebody qualified to give it. Reading it, listening to it, writing to us, or being coached by us does not create a doctor and patient, therapist and client, counsellor, fiduciary or other professional relationship, and it does not make anyone here responsible for your care.

Louis Ruggiero Jr. is not a physician, a psychiatrist, a psychologist, a licensed therapist, a licensed addiction counsellor, a financial adviser or a lawyer, and nothing on this site should be read as claiming otherwise. Decisions about treatment, medication, money and law are for you and for the professionals you choose. If you are being treated for anything, do not change what you are doing because of something you heard here without talking to the person treating you.

In an emergency call 911. In a crisis in the United States, call or text 988 for the Suicide and Crisis Lifeline. For gambling specifically, call or text 1-800-GAMBLER. The forms on this site are not monitored around the clock and must not be used to report an emergency.

03Who can use the site

You may read this site and listen to the show at any age, and we have deliberately not put a wall in front of the episodes: a young person worried about a parent or about themselves should be able to find this.

The forms and the services are a different matter. You must be at least 18 to submit a form, to apply to be a guest, or to engage us for coaching, speaking or sponsorship. If you are under 18 and you need help, please talk to an adult you trust, or use one of the helplines on our Get help page, which are open to you.

04The show and this site

You may read, listen, link to us, and share what is here. You may quote us with attribution. What you may not do is republish an episode or a substantial part of this site as your own, sell it, or present it as somebody else's work.

You also agree not to: break the site or try to; get around a rate limit or a security measure; scrape it at a volume that costs us money or degrades it for other people; harvest personal information from it; or use it to do anything unlawful.

Text and data mining

We expressly reserve the rights in this site and in the show against text and data mining and against use as training data for machine learning or generative models, including under Article 4 of EU Directive 2019/790. No licence for those uses is granted by the site being publicly readable, and no automated permission signal should be read as one. If you want to license this material for such a use, write to us and ask.

05Applying to be a guest

The guest form is an application, not a booking. Sending it does not put you on the show, and we may say no or say nothing without giving a reason. There are more applications than there are slots.

  • Nothing you send is recorded or published. If we go ahead, we will agree a separate written release with you first, covering the recording, what may be used, and where it may appear.
  • That release is where your rights over your name, voice, likeness and story are dealt with, including your rights under sections 50 and 51 of the New York Civil Rights Law. Nothing in these terms takes them from you.
  • Please do not send us other people's private information. Tell your own story. If you name somebody else, only tell us what you would be willing to say in front of them.
  • By sending an application you confirm that what you have told us is true to the best of your knowledge, and that you have the right to tell us it.
  • If you change your mind at any point before recording, write to us and that is the end of it. No explanation needed.

06Coaching

The coaching page describes what a month of working with Louis involves. It is an invitation to apply. It is not an offer, no price is quoted on this site, no payment is taken on this site, and submitting the form does not form a contract or reserve a place.

If we both decide to go ahead, the terms of that work are agreed between us separately and in writing before it starts: what it costs, when it is paid, what happens if a call is missed, and how either of us can end it. Those terms govern the coaching. These ones govern the website.

Coaching is mentoring from somebody who has been through it. It is not therapy, not treatment, not a clinical programme, and not a substitute for any of them. We do not diagnose, we do not treat, and we do not prescribe. Nobody can promise you an outcome in recovery and we do not: what you get out of it depends mostly on you, and any account of somebody else's experience is theirs and not a prediction about yours.

The training and nutrition programme mentioned on that page comes from a third-party fitness coach and is general fitness information, not medical advice. Talk to a doctor before starting it, particularly if you have any condition that exercise or a change of diet could affect.

07The Monday night meeting

Gamblers Anonymous is an independent fellowship. It is not affiliated with this show, with this site, or with any service we sell, and it does not endorse, sponsor or approve any of them. Louis attends and hosts a meeting as a member like anyone else. Nothing you pay us goes to Gamblers Anonymous, and nothing about the meeting is for sale.

The meeting runs on Zoom, which is a third-party service under its own terms and privacy policy. We do not control it and we cannot see more about you than any other participant can.

  • The meeting is free, and it always will be. Nothing is sold in it and nobody is pitched in it.
  • What is said in the meeting stays in the meeting. Do not record it, screenshot it, or repeat who was there or what they said.
  • You can keep your camera off and say nothing. That is a normal way to attend, not a lesser one.
  • We may end a session, or remove someone from it, if the room stops being safe.
  • It is a peer support meeting, not a clinical service, and it is not supervised by a professional.

08What you send us

You keep ownership of what you write to us. To be able to read it, reply to it, and discuss it internally, you give us permission to use it for those purposes. That permission goes no further: we will not publish, broadcast or quote what you sent us in a form without asking you first and getting your agreement.

Please do not send us anything confidential that you are not free to share, anything that infringes someone else's rights, or anything unlawful.

09Advertising and sponsorship

Some episodes carry sponsorship, and where they do it is disclosed in the episode itself, as the Federal Trade Commission's rules on endorsements require. A sponsor pays for the placement, not for an opinion, and a sponsor has never had and will never have a say in what a guest says or in what we say about the gambling industry.

We do not take money from sportsbooks, casinos, daily fantasy or prediction market operators, offshore betting sites, gambling affiliate schemes, or anything that pays out on a wager. That list is on the sponsorship page and it is not negotiable.

A sponsor's product is theirs, not ours. We are not responsible for what a sponsor sells you, and any dealing you have with one is between you and them.

10Links and other people's platforms

This site links out a great deal, including to crisis lines, meeting finders and treatment resources. We link to them because we think they help. We do not run them, we cannot vouch for what they will tell you, and a link is not an endorsement of everything on the other side of it. The helplines and fellowships we point to are independent organisations and none of them endorses this show.

Any merchandise store we link to is operated on a third-party platform, and a purchase there is governed by that store's own terms, not by these.

11Our name and our work

"Nothing's Off The Table" and the marks, wordmark, design, text, photography and episode recordings on this site belong to LMJ Productions or to the people we licensed them from, and are protected by copyright and trade mark law. Using the site does not give you any right in them beyond what is written above.

If you believe something here infringes your copyright, write to lj@nothingsoffpod.com with enough detail to identify the work and where it appears, your contact details, a statement that you believe in good faith that the use is not authorised, and a statement that the information in your notice is accurate. We will look at it promptly and remove anything we should not be using. If you think we removed something of yours in error, tell us and we will look again.

12What we do not promise

The site is provided as it is. We do not promise that it will always be available, that it will be free of errors, or that anything on it is complete, current or right for your situation. Episode descriptions, figures and resource details are given in good faith and may be out of date. Verify anything you are going to rely on, especially a helpline number or a meeting time.

To the fullest extent the law allows, we exclude all warranties that are not written down here, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

13Limits on liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or lost opportunity, arising out of your use of this site, even if we were told such damages were possible.

Where we are liable, our total liability arising out of the site is limited to one hundred United States dollars, or the amount you have paid us in the twelve months before the claim, whichever is greater.

Some things cannot be limited and we are not trying to limit them. Nothing in these terms excludes or limits our liability for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, for death or personal injury caused by our negligence, or for anything else that the law does not permit to be excluded. If you are a consumer, nothing here affects your statutory rights, and some jurisdictions do not allow the exclusions above, in which case they apply to you only as far as that jurisdiction permits.

You agree to cover us for claims, losses and reasonable legal costs arising from your breach of these terms, from anything unlawful you do using the site, or from information you sent us that you had no right to send.

14Governing law and where disputes go

These terms are governed by the law of the State of New York, without regard to its conflict of laws rules. Any dispute arising out of them or out of the site is subject to the exclusive jurisdiction of the state and federal courts located in Suffolk County, New York, and you and we each consent to that venue.

If you are a consumer resident in the UK or the EU, this does not deprive you of the protection of the mandatory laws of your own country, or of your right to bring proceedings in your local courts where the law gives it to you. Before anyone files anything, we would much rather you wrote to lj@nothingsoffpod.com and gave us a chance to fix it.

15Accessibility

We build this site to meet the Web Content Accessibility Guidelines version 2.2 at level AA: it works from the keyboard, it respects a reduced-motion setting, it can be read by a screen reader, and it does not depend on colour alone to make a point. If any part of it keeps you from what you came for, tell us at lj@nothingsoffpod.com and describe what happened. We will fix it and, until we have, we will get you the information another way.

16The rest

  • We may change these terms. If we change something that matters we will update the date at the top and say what changed. Continuing to use the site after that means you accept the new version.
  • We may change or discontinue any part of the site.
  • If a court finds part of these terms unenforceable, the rest still stands and that part is narrowed only as far as necessary.
  • Not enforcing something once does not waive it.
  • You may not transfer your rights under these terms. We may transfer ours if the show or the business changes hands, and your rights go with them.
  • These terms, together with the Privacy Policy and the Cookie Policy, are the whole agreement between us about the website.
